By Junior Mayema,
Here today i wanna talk about the interconnectedness of human rights violation in Africa , international law and what need to be done in order to stop impunity, violence and state sponsor homophobia in Africa and in most of world countries.
First of all i will start by the export of homophobia in Africa by mostly American right-wing evangelists and how it can be sued here in the United States as soon as you gather relevant evidences of that.
There was a report about the Influence of U.S. Religious Conservatives in Promoting Homophobia in Africa here is one link :
And there is another report published by Human rights campaign below:
Appeals court: ‘Crimes against humanity’ case against Scott Lively can proceed
So these are evidences of American exporting religious extremism overseas of course we can sue them here in America for crime against humanity, it is called Alien Tort Statute (ATS)
seeking accountability for Americans who commit or incite crime against humanity overseas , this is how we can hold accountable Americans who commit human rights violations abroad.
And we can also monitor directly human rights violations against LGBT people in Africa committed by their own governments and people getting away with impunity because national laws or court can’t hold them accountable by approaching International criminal court with Rome Statute of the International Criminal Court
that was established for prosecution of four core international crimes: genocide
, crimes against humanity
, war crimes
, and the crime of aggression
. Those crimes “shall not be subject to any statute of limitations
Under the Rome Statute, the ICC can only investigate and prosecute the four core international crimes in situations where states are “unable” or “unwilling” to do so themselves. The court has jurisdiction over crimes only if they are committed in the territory of a state party or if they are committed by a national of a state party; an exception to this rule is that the ICC may also have jurisdiction over crimes if its jurisdiction is authorized by the United Nations Security Council that is
it is important to write a shadow report to the African Commission on Human and Peoples’ Rights
because there is a resolution on sexual orientation and gender identity:
275: Resolution on Protection against Violence and other Human Rights Violations against Persons on the basis of their real or imputed Sexual Orientation or Gender Identity
we must report to the United Nations human rights council and even to invite a United Nations special rapporteur to investigate impunity and violence in homophobic countries, here is infos about the resolution on sexual orientation and gender identity within the United Nations:
So the United Nations human rights council can lobby the United Nations security council to force the international criminal court to take up one case of crime against humanity against LGBT people that are being committed against LGBT people with impunity in the world
there is an amazing Uganda activist who was trying to sue the author of antigay law in his country to the international criminal court but he just had to follow the proper channels and process of the Rome Statute of the international criminal court here is a link to how he petitioned the International Supreme Court:
International Criminal Court: Investigate and Prosecute The Top 3 Homophobic Ugandans For Crimes Against Humanity
and this is what is happening so far in Africa in Zimbabwe:
The leading Zimbabwean LGBT rights group has responded to reports that its members were injured after an attack on Friday.
Gays and Lesbians of Zimbabwe (GALZ), were attacked and injured at the private event on Friday, according to the organisation.
The International HIV/AIDS Alliance on Monday expressed “extreme concern” at the reports that the GALZ members were attacked.
Gavin Reid, the Alliance’s Regional Advisor on Men’s Sexual Health & Rights for East and Southern Africa said: “The International HIV/AIDS Alliance calls upon the Zimbabwean police to investigate the incident and bring the perpetrators to justice. It’s the duty of the Zimbabwean government to protect and promote the rights of all its citizens and to ensure that all Zimbabweans are able to enjoy their full constitutional rights including the right to life, to personal security, to freedom of assembly and association, and to freedom from torture.”https://juniorstopdiscriminationtodaymayema.wordpress.com/wp-admin/post.php?post=77&action=edit
GALZ says a rise in violence against the LGBT community had taken place recently, and that “most at risk groups face living in a climate of fear and criminalised for their behaviour.”
“It not only makes them a target for harassment and violence, but also creates a vacuum when it comes to the provision of healthcare and support services for all minority groups.”
And there is another report from Gambia :
