Uganda plans to ratify the Malabo protocol which could end its association with the Hague-based International Criminal Court.
In the just concluded 24th ordinary summit in Addis Ababa, African leaders agreed that Africa must establish a court to deal with the continent’s peculiar problems.
The Malabo Protocol seeks to merge the existing African Human Rights Court and the African Court of Justice into one to have the jurisdiction to try war crimes and crimes against humanity.

African foreign ministers were also reportedly angry over what they called a threat by some European partners to stop funding should AU insist on founding the African court.
Kenya has spearheaded calls on African countries to sign the draft statute of the African Court during the meeting and Sudan also expressed full support for the move, stressing its intention to sign it.
The African Union constantly accuses the ICC of disproportionately targeting Africans. Several countries including Kenya, Sudan, Eritrea, Uganda, Zimbabwe and Libya have called for en mass withdrawal of African nations from the court at some point but without success.
The ICC has formally opened investigations into eight cases, all of which are in Africa including Uganda, the Democratic Republic of the Congo (DRC), Central African Republic (CAR), Darfur, Kenya, Libya, Côte d’Ivoire and Mali.

The United Nations Secretary-General Ki-moon Ban noted other positive developments from the previous year, including affirmation by the AU’s Human Rights Commission of the rights of lesbian, gay bisexual and transgender (LGBT) individuals and the Cotonou Declaration on the abolition of the death penalty in Africa. He was also pleased to welcome the AU Commission of Inquiry report on South Sudan and the final report of the Commission of Inquiry for the Central African Republic.

Uganda’s Foreign Minister Sails Through U.N. Election Despite Concerns Over LGBT Law
Sam Kutesa, a former Ugandan minister, was appointed unopposed by the Assembly’s Africa block in June – despite a petition against his appointment signed by more than 13,000 people.
Mr Kutesa previously claimed that the majority of Africans “abhor” homosexuality, and strongly supports Uganda’s Anti-Homosexuality Act.
The politician took a swipe at his opponents this week, while visiting his native Uganda.
According to the Daily Monitor, he addressed the controversy by saying: “It is not a problem. I had been nominated by my country Uganda and the African continent had endorsed me.
“No matter how much noise the frogs make, they cannot stop a cow from drinking water.”
Labour’s Michael Cashman had previously called on the UK Government to block Mr Kutesa’s appointment.
Mr Cashman said: “As a cabinet member and supporter of the Anti-Homosexuality Act, which was signed by the Ugandan President four months ago, Mr Kutesa bears direct responsibility for this law and the rampant homophobia in Ugandan society.”

Robert Mugabe of Zimbabwe has been appointed the new Chairman of the 54-nation African Union, at the two-day heads of state summit in Ethiopia’s capital, Addis Ababa.
After 25 years in office, Mugabe, the 3rd longest serving African President, now 90, is most known for his oppressive dictatorial governance, poor human rights record and vehement anti-gay rhetoric.
“The ascension of Mugabe, one of Africa’s most divisive figures, to the rotating position has drawn criticism.
Obert Gutu, a spokesman for the Zimbabwean opposition party Movement for Democratic Change (MDC), said that Mugabe “has trashed democracy in Zimbabwe and he and his party have ruined the economy”. “He lacks the political legitimacy to lead an Africa that should be looking to consolidate democracy and good governance.”
Zimbabwe, a once-prosperous nation of 13 million people in Southern Africa, has struggled since Mugabe’s government began seizing farms owned by Caucasian people in 2000.
The president is also accused of using widespread violence to win several disputed elections, according to human rights groups. The country had suffered hyperinflation until it abandoned its currency for the US dollar in 2009.”
Melanie Nathan, the Executive Director of African Human Rights Coalition noted: “This is most disappointing. Mr. Mugabe’s appointment sends the message that praises dictatorial regimes. It is a lauding of autocracy, serving a harsh blow to those who strive for Democracy, where leadership changes on a regular basis. Though merely a symbolic role, the stature of the position elevates Mugabe, rewarding and validating human rights abuses, oppression and corruption.”
In conclusion being LGBT is not something to play around with even pastors and evangelicals are gays so be careful when pointing fingers and judging others today
